Breakthrough Broker Plus TOU

These Breakthrough Broker Plus Terms of Use (“BB Plus Terms”) establish the additional terms under which the Breakthrough Broker Plus service (“BB Plus Subscription”) is provided to you. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these BB Plus Terms.

Monthly Subscription: By purchasing a monthly BB Plus Subscription, you agree to an initial and recurring monthly subscription fee at the then-current monthly subscription rate, and you accept responsibility for all recurring charges until you cancel your BB Plus Subscription. Your BB Plus Subscription will automatically bill your credit card for the then-current monthly subscription fee. This fee will be processed on the date you subscribed until you cancel your BB Plus Subscription. If your credit card or other payment method is not received on your normal recurring billing date for your BB Plus Subscription, you will automatically be downgraded to a free profile. Your Plus Subscription may be cancelled upon written notice to us, such cancellation will become effective at the end of the then current month.

Annual Subscription: By purchasing an annual BB Plus Subscription, you agree to a non-refundable pre-payment for one full year. The annual BB Plus Subscription will automatically renew each year, at prevailing rates, on a recurring basis from the date your annual BB Plus Subscription is purchased, until cancelled by you in writing to us, with such cancellation becoming effective at the end of the then current term. If your credit card or other payment method is not received on your normal recurring billing date for your BB Plus Subscription, you will automatically be downgraded to a free profile.

Automated Marketing Package and MLS Look up TOU

These Automated Marketing Package terms of use (“AMP / MLS Look up Terms”) establish the additional terms under which the Automated Marketing Package service (“AMP”) and the MLS Look up Service (“MLS Look up”) are provided to you. Please note the MLS Look up is an additional feature that might not be included in your Services. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these AMP / MLS Look up Terms.

You agree and acknowledge the Automated Marketing Package and the MLS Loop up services utilize a third-party to obtain available MLS data (“Contracted Listing Data”) and may not be available in all geographic regions and/or MLSs throughout the country. If you wish to utilize listing data from a MLS that is not included in the Contracted Listing Data (“Additional Listing Data”), a separate data feed will be required and we cannot guarantee we will be able to obtain such Additional Listing Data. If such Additional Listing Data is obtained, additional set up fees and monthly service fees may be applied.

You agree and acknowledge the following with your use of the AMP / MLS Lookup features:

• Contracted Listing Data and any Additional Listing Data (collectively “Listing Data”), is provided to Breakthrough Broker by third parties and Breakthrough Broker is not responsible for, nor do we guarantee the availability or accuracy of such Listing Data.
• When available, only the following Listing Data will be available on AMP and MLS Lookup designs: 1) Price; 2) Description; 3) Beds; 4) Baths; 5) Square Feet; and 6) Photos.
• Photos in the Listing Data do not have any data by which we can assign said photo to a particular location on a design. We will make all reasonable efforts to place photos in the order they are provided by the third party source to the most prominent locations on each design.
• We have no control of the photos provided in the Listing Data, and some photos may contain watermarks.
• Not all designs will be part of the AMP and MLS Look up services and the designs provided as part of AMP and MLS Look up are subject to change.
• Your Content may or may not be available to be included with AMP and MLS Lookup. Upon request, Your Content will be reviewed and if possible we will provide you with an estimate of cost for inclusion.
• Some Listing Data may not be compatible with all AMP and MLLook-upup services.
• While the AMP and MLS Look up services are intended to save you time, any Listing Data is subject to our Data Fill Terms, which are incorporated herein.
• The AMP designs are not updated throughout the lifecycle of the Listing Data, and will not automatically be updated. For example, if a listing’s price is subsequently updated the AMP will not automatically be updated nor will the user receive a new AMP email.
  You have been provided with adequate demonstration of the AMP and MLS Look up services and you accept all functionality "as is" and any agreed upon changes to functionality may be at your expense.

Listing Showcase TOU

These Listing Showcase terms of use (“Listing Showcase Terms”) establish the additional terms under which the Listing Showcase feature (“Listing Showcase”) is provided to you. Please note the Listing Showcase is an additional feature that might not be included in your Services and/or additional fees may apply. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these Listing Showcase Terms.

You agree and acknowledge the following in connection with your use of the Listing Showcase: Listing Showcase may utilize Listing Data and the AMP / MLS Look up Terms and Data Fill Terms may apply and are incorporated by herein reference. You are responsible for Your Content in the Listing Showcase and all final reviews prior to publishing a Listing Showcase.
The Listing Showcase may also include the optional feature of allowing a consumer to contact you directly, you are solely responsible for use of this feature.
Additional Compliance Obligations related to your use of the Listing Showcase feature may apply and are your sole responsibility. You are responsible for publication and removal of any Listing Showcase. Breakthrough Broker may remove a published Listing Showcase at any time and for any reason, upon their sole discretion.

Printing TOU

These Printing terms of use (“Print Terms”) establish the additional terms under which the print Service is provided to you. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these Print Terms.
You agree and acknowledge the Print Services utilize a third-party and may not be available in all geographic regions. Availability of paper types, finishing options and shipping options vary and are not guaranteed.
You are responsible for final proof and layout approval prior to the printing process.  Any print jobs (“Print Services”) that have been approved and/or or sent to productions cannot be altered or changed due to the nature of the printing process, and no refund will be given. An online proof will be available for your review after you have uploaded your files. No job will be sent to production without your approval.  An online proof is not an accurate color reproduction of your final printed piece but is the final opportunity for you to check the layout, bleeds, margins, crops and final text. Therefore, we will not be liable for color variation between the proof and the printed product.  We will try our best to ensure a match between the colors of the proof and the printed product but please understand that color variation differences are inherent inconsistencies of the printing process and we will not be held responsible for it. You are fully responsible for all that is contained in the final approved proof, so please make sure you check against the original file for possible errors in layout, Data Fill, copy, spacing, punctuation or image placement. You also agree and acknowledge that final output files created from Print Services may have a standard deviation of 0.0625inches or 1/8inch. Items printed and shipped may be damaged in the mailing process. This damage varies and is inherent to the mailing process, we shall not be responsible for the damage or any associated cost related to shipped items damaged by Mail Carrier. All production timeframes are estimates and not guaranteed. Additional fees apply. The availability of Print Services and the costs of printing are subject to change. All sales are final. You also agree and acknowledge that Breakthrough Broker receives revenue from all Printing Services.

Mailing TOU

These mailing terms of use (“Mailing Terms”) establish the additional terms under which the mail Service is provided to you. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these Mail Terms.

You agree and acknowledge that we utilize a third-party for mailing and this service may not be available in all geographic regions. When utilizing our mailing services, our responsibility is limited to preparing your mailing, either based on Your Content or Purchased Mailing Lists, and completing delivery to your selected mail carrier (including but not limited to U.S. Postal Service and UPS) (“Mail Carrier”). All mailing delivery dates are estimates, not guarantees. We shall not be liable for Mail Carrier performance failures or delivery delays.

We may offer you the option to purchase specific mailing lists (“Purchased Mailing Lists”). These Purchased Mailing Lists may be sourced from third parties, and we cannot offer any guarantees of the deliverability or accuracy of the Purchased Mailing Lists. Client remains fully responsible for payment of any Purchased Mailing List, regardless of whether printing and/or mailing portion of the order is cancelled. The Purchased Mailing List may be used only for your marketing purposes and may not be transferred or sold to other parties.

Additional fees apply. These availability of mailing services and the costs of mailing are subject to change. All sales are final.

Translation TOU

These translation terms of use (“Translation Terms”) establish the additional terms under which the translation Service is provided to you. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these Translation Terms.

The Service may include translations, these have been provided for your convenience and are provided to you “as is”. Your use of any translations is at your own risk. No warranty of any kind, either expressed or implied, is made as to the accuracy, reliability, or correctness of any translations made from English into any other language. The official text for all Services is the English language version. If you have any questions related to the accuracy of the information contained in the translation, please refer to the English version.

Single Sign On TOU

These Single Sign On (“SSO”) terms of use (“SSO Terms”) establish the additional terms under which the SSO Service is provided to you. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these SSO Terms.

Breakthrough Broker may provide a Breakthrough Broker Client or you with access to SSO services. SSO shall always be subject to these SSO Terms. SSO will only be available if Breakthrough Broker enters into agreements with third-party providers for such service. When Breakthrough Broker’s agreement with a third-party provider terminates, your access to and use of the third-party provider’s product or service using the SSO shall also terminate. All Services and third-party materials accessed under the SSO will be linked to and may be accessed by a single set of credentials. You are responsible for ensuring no unauthorized access occurs. You agree that Breakthrough Broker shall have no responsibility or liability whatsoever from any claims made as a result or related to use of SSO services. You also understand and agree that SSO might not be available for all, and additional fees may apply.

Data Fill TOU

These Data Fill Service terms of use (“Data Fill Terms”) establish the additional terms under which the Data Fill Service is provided to you. The Breakthrough Broker Terms and Conditions (“Terms”) are incorporated by references into and made a part of these Data Fill Terms.

Breakthrough Broker may provide a Breakthrough Broker Client or you with the ability to auto fill / complete and / or manually input text in certain data fields of the Services without viewing the entire text of the document being completed (“Data Fill Feature”). You acknowledge that you will review the Services and / or document in its entirety with all text and data revealed before you send, use, or print using the Data Fill Feature. You agree that Breakthrough Broker has no responsibility or liability whatsoever which might result from your use of a Data Fill Feature.
